Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Spray mobile application ("App") or visiting our website at sprayar.art ("Website"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services.

2. Description of Service

Spray is an augmented reality (AR) art creation platform that allows users to create, anchor, and discover digital artwork in physical locations. The App includes AI-powered generation tools, social features, and a credit-based system for premium functionality.

3. Eligibility

You must be at least 13 years of age to use Spray. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account and to update it as necessary. We reserve the right to suspend or terminate accounts that violate these Terms.

5. Subscriptions and Payments

Spray offers optional auto-renewable subscriptions ("Spark") that provide additional credits and features. By subscribing, you agree to the following:

• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.
• You can manage and cancel your subscription in your device's Settings > Apple ID > Subscriptions.
• No refunds will be provided for any unused portion of a subscription period, except as required by applicable law.

6. Credits

Credits are a virtual currency used within the App to access AI generation, inpainting, and anchor placement features. Credits have no monetary value outside the App, cannot be transferred to other users (except through future gifting features), and are non-refundable. Unused monthly subscription credits do not roll over to the next billing period. Bonus credits earned through activity persist until used.

7. User Content

You retain ownership of the artwork and content you create using Spray. By posting content publicly, you grant Spray a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your content within the App and on our marketing channels. You represent that your content does not infringe on any third-party rights and does not contain illegal, harmful, or offensive material.

8. AI-Generated Content

Content generated using Spray's AI tools is created using third-party AI models. You are responsible for reviewing AI-generated content before publishing. Spray does not guarantee the accuracy, originality, or appropriateness of AI-generated outputs. You agree not to use AI features to generate content that is illegal, harmful, deceptive, or infringes on intellectual property rights.

9. Prohibited Conduct

You agree not to:

• Use the App for any unlawful purpose
• Post content that is obscene, defamatory, threatening, or hateful
• Attempt to gain unauthorized access to other users' accounts or our systems
• Interfere with or disrupt the App's functionality
• Use bots, scrapers, or automated tools to interact with the App
• Manipulate the credit system or exploit bugs for unintended benefits

10. Intellectual Property

The Spray name, logo, App design, and all associated intellectual property are owned by Spray and its licensors. You may not copy, modify, distribute, or create derivative works from our intellectual property without prior written consent.

11. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components. AR features depend on device capabilities and environmental conditions that are outside our control.

12. Limitation of Liability

To the maximum extent permitted by law, Spray and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of profits, or damage to your device.

13. Account Termination

You may delete your account at any time through the App's settings. We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the App ceases immediately, and any remaining credits are forfeited.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the App or by email. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms shall be resolved in the courts of competent jurisdiction.
